Warranty

Virtual Access warrants to the original consumer or end-user purchaser that the Service Managed Gateway is free from defects in material and workmanship. During the warranty period, and upon proof of purchase, the product will be repaired or replaced (with the same or similar model) at our discretion without charge for either parts or labour. The warranty is invalidated if the product is modified, misused, tampered with or subject to abnormal working conditions.

REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE EXCLUSIVE REMEDY OF THE PURCHASER. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE, AND Virtual Access SHALL IN NO EVENT BE LIABLE TO PURCHASER FOR INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND OR CHARACTER. The period of warranty starts on the date of purchase and extends one (1) year for both hardware and software, or in accordance with any terms and conditions that may have been separately negotiated as part of a supply contract and under which the product was purchased. THIS WARRANTY APPLIES TO THE PRODUCT ONLY AND DOES NOT COVER ANY OTHER SOFTWARE OR HARDWARE WHICH MAY BE INCLUDED WITH YOUR PURCHASE OF THE PRODUCT. Should you find any defect with your Service Managed Gateway during the warranty period please contact your original supplier or retailer.

Electrical Safety Advisory

The Service Managed Gateway is a class I/II apparatus.

It is strongly suggested that an AC surge arrestor is installed in the AC outlet to which this equipment is connected.

For the GW4000 and GW6000 plug in the power supply to a socket that is no more than 190cm away from the Service Managed Gateway.

For the GW5000 and the GW7000 plug in the power supply to a socket that is no more than 260cm away from the Service Managed Gateway.

Notices

HIGH VOLTAGES Under no circumstances is the Service Managed Gateway to be operated with the cover removed.

DANGEROUS SUBSTANCES Semiconductor devices contain dangerous substances, such as beryllium and arsenic. Electronic devices must not be opened. If they become damaged, they must only be handled using protective gloves. If the substances inside the electronic devices come into contact with broken skin or wounds, hospital care must be sought immediately. Electronic components must be disposed of as hazardous toxic waste and must not be incinerated.

TECHNICAL SUPPORT Technical support for the Service Managed Gateway should be obtained from your reseller or network service provider. Before you request technical support for any of the Virtual Access SMG products, make sure you have the following information readily available:

Each Service Managed Gateway is assigned a unique serial number labelled on the bottom of the device. This number is required should you request service on the device. Record your device serial number on a printed copy of this warranty or somewhere you can easily access it.

Compliance with 93/68/EEC CE Marking Directive

To meet the requirements of the CE Marking Directive 93/68/EEC, and to indicate compliance to National Type Examination, Safety, Production Quality Assurance and Electro Magnetic Compatibility requirements the following symbol is used:

Electro-Magnetic Compatibility

Compliance with EC Directive 92/31/EEC on Electromagnetic Compatibility

This product meets the requirements of EC Directive 89/336/EEC.

It should be noted by the user or installer of the product that to comply with the Electro-magnetic immunity requirements the host computer must also meet the requirements of this directive and provide a suitable earth connection to the Service Managed Gateway.

All Service Managed Gateway products meet the requirements of EN50081 Class B, for domestic and light industrial environments.

Licence Agreement

This License constitutes an agreement between you (the end user) and Virtual Access (Irl) Ltd. (hereinafter "Virtual Access"). This License applies to the software ("Software") and related explanatory written materials ("Documentation"). The term "Software" shall also include any upgrades, modified versions, updates, additions, and copies of the Software licensed to you by Virtual Access.

You should read these terms carefully. By installing or using the Software, you agree to be bound by these Terms and Conditions. If these Terms and Conditions are not accepted in full, you are not authorised to use the Software.

1. GRANT OF LICENCE
Virtual Access grants you the right to install the Software in a single location on a hard disk or other storage device. You may use upgrade Software only to replace or enhance your earlier licensed version of the Software. You may not use, copy, modify, adapt, translate, reverse engineer, de-compile or disassemble the Software, except as permitted hereunder or to the extent such acts may not be prohibited by law in the country of use or create derivative works based on the Software. All rights not expressly granted are reserved by Virtual Access or its licensors.

2. COPYRIGHT
The Software and all copyright and other rights in it are owned by Virtual Access or its licensors.

3. TERMINATION OF LICENCE
You may terminate this License at any time by destroying the Software and archival copy. Virtual Access may terminate this License if you fail to comply with its terms and conditions. Upon such termination you shall destroy the Software and archival copy and confirm to Virtual Access in writing that you have done so.

4. OTHER RESTRICTIONS
You acknowledge that this License is personal to you and neither this License nor the Software may be transferred, sub-licensed or otherwise assigned. Any export of the Software is subject to the requirements and restrictions of applicable laws and regulations, including but not limited to the Export Administration Regulations of the United States of America. You may configure the Software for your own use provided it is in support of your Authorized Use.

5. LIMITED WARRANTY
Virtual Access warrants that the Software will perform with normal use substantially in accordance with the accompanying material for a period of ninety (90) days from the date of receipt. This warranty is void if failure of the Software has resulted from accident or misuse. Any replacement of the Software will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

6. END USER REMEDIES
Virtual Access's entire liability and your exclusive remedy in the event that a valid claim is made by you to Virtual Access within the terms of the aforesaid warranty shall be either the return of the price paid by you for the license of the Software (if any) or, at Virtual Access's option, the repair or replacement of the Software.

7. NO OTHER WARRANTIES
Virtual Access AND ITS LICENSORS DISCLAIM ALL OTHER CONDITIONS OR WARRANTIES EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE WHICH ARE HEREBY EXPRESSLY EXCLUDED TO THE EXTENT PERMITTED BY LAW. FOR THE AVOIDANCE OF DOUBT, NEITHER Virtual Access NOR ITS LICENSORS WARRANT THE QUALITY OR ACCURACY OF ANY INFORMATION OR DOCUMENTATION RESULTING FROM OR TRANSMITTED USING THE SOFTWARE. THERE IS NO WARRANTY BY Virtual Access OR ANY OTHER PARTY OR PERSON THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE. YOU ASSUME ALL RESPONSIBILITY FOR THE SELECTION OF THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE INSTALLATION, USE AND RESULTS OBTAINED FROM IT.

8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES
NEITHER Virtual Access NOR ITS LICENSORS SHALL BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS, OR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF USE, LOSS OF CONTRACTS, ANTICIPATED SAVINGS OR FOR ANY ECONOMIC OR FINANCIAL LOSS WHATSOEVER AND HOWSOEVER SUFFERED, EVEN IF Virtual Access HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with Irish law (excluding Northern Ireland) and each Party agrees to submit to the exclusive jurisdiction of the Courts of Ireland.
